1273 Fornaxian to be sentenced to death for several acts of treason

PFP, FSP dissolved: court's order
After executing acts of treason, both People's Fornax Party (PFP) and Fornax Socialist Party (FSP) will be dissolved with immediate effect. All PFP and FSP members will be charged with several counts of treason. The punishment for treason is a death sentence. It is predicted that all PFP and FSP members will be executed, a total of 852 and 421 members respectively. In the past, the now dissolved United People' Party had all its 791 members charged with treason and sentenced to death by hanging in 1997.

All members of PFP and FSP will be given a chance to defend themselves on the following dates on November: 6th, 13th, 20th and 27th. The verdict will be out on December 11, 2010.

PFP were charged with 3 counts of treason:
Harming another political party (FSP Headquarters bombing)
Planning an assassination against the President (Acting President Crystal Paterson Assassination plot)
Assassinating the President (Acting President Pang Assassination plot)

FSP were charged with 1 count of treason and 1 count of murder:
Murder (Former CEO of CAG Low Assassination plot)
Assassinating the President (Acting President Mao and his family Asassination plot)

According to the Fornaxian Penal Code, both murder and treason will result in capital punishment by lethal injection. Therefore, all members of PFP (852 members) and FSP (421 member) will be charged wth several conuts of murder and treason (depending on which party). Assisting in any murder or treason plans will also result in capital punishment.

As the total number of 1273 people will be punished by capital punishment, seeing that the number of people convicted is huge, is it neccessary for the AIN Court to approve the sentencing of all 1273 people to capital punishment?

The Chief Justice will need to make that decision.

The Calaréann Government is shocked and appalled that such charges could be leveled at an entire political party. Whilst the Calaréann Government would not seek to involve itself in the internal justice system of a member state, It would seek to ensure a transparent process was engaged to bring the real perpetrators of the crimes to justice. Anything other then a full judicial enquiry into these matters would amount to Political Genocide, and the Alliance cannot and should not stand for it. If such an enquiry was not held in a timely and transparent manner then the Crowned Republic of Calaré would have no option but to look into diplomatic and economic sanctions against Fornax.

At the present time the Fornax ambassador to Calaré is being called in to the Calaréann Foreign ministry to explain these matters to Foreign Minister Ms Sofia Ascot.

In light of the views of external countries, extensive investigations will be conducted under the Fornaxian investigation policy and will be release to the public as soon as possible. All 1273 accused will be given a chance to defend themselves if any member did not or are not aware of such cases of murder and treason being planned within their own party.

Anyone found planning any murder or treason plots will be charged with murder and treason respectively. Likewise, anyone found to be helping these planners by any means, including failing to report the incident to the authorities, will be charged for assisting the murder and treason plots respectively. The punishment for both cases is a death sentence.

The verdict that will tentatively be out on December 11th will not be subjected to any international political pressure. Once the verdict is out, the Fornaxian High Court will then submit the case to the AIN Court for approval of sentencing the death sentence if it is required. If it is not required, the High Court will proceed on with the punishment.

No matter what is the outcome, both the People Fornax Party and Fornax Socialist Party will be dissolved and banned. The Fornaxian Penal Code will also be acted upon for the best for its people, and not under international pressure.

Bombing of FSP Headquarters
On October 19, 2010, in Sypogen during the evening rush hour at about 6.12pm, the FSP's Headquarter was attacked, killing all 44 people present in the building. A bomb exploded at the reception lobby, the front entrance of the headquarter, causing debris to block the main escape route. A fire was then started, engulfing the entrance within minutes. The fire department then receive a call at 6.15pm and an emergency crew consisting of fire engines and ambulances were dispatched immediately, expecting to arrive within 15 minutes. However, due to extensive road diversion within the area of the headquarter because to road works, the emergency crew could not arrive on time, reaching at the site at 7.34pm. By the, the fire has engulfed the whole building. Firefighter immediately attempted to douse the inferno. By around 2.30am, the fire was under control and at 4.10am, the fire was fully extinguish. Unfortunately, no one survived, including FSP Secretary-General Goh Kim Leong.

The police then come the aftermath for evidence, in which they found a few CCTV recorded footages still intact; the rest are damaged beyond repair. The recovered CCTV footages shows three male carrying a huge haversack each entering the reception lobby seconds before the explosion. Upon close footage, it was revealved that the three male were members of the People Fornax Party (PFP). Other recovered CCTV footages also shows that A search warrant for all of the party's compound countrywide is up. Police then found evidence in most of the compounds about the FSP Headquarter Bombing plot, in which the evidence includes pictures and videos taken of the targetted headquarter and other FSP compounds countrywide, instructions and manuals of bomb-making and the effectiveness of several bomb, and a list of FSP members and their daily activities. With evidences for the other 2 treason cases PFP is accused of, PFP was then dissolved and banned by the High Court.

Before I give my statement on this, I need to understand the political asylum and how it works. What they wrote on Wikipedia is very confusing to me.

1) If a country is not a party to either the UN Convention Relating to the Status of Refugees and/or the UN Protocol Relating to the Status of Refugees, can the country grant politcial asylum for another people from another country? Likewise, can someone from another country ask for political asylum in the country which is not a party to the either or both Convention and Protocol?
2) Assume Fornax is a party to both Convention and Protocol, can Fornax deny the accuse's application for political asylum under, let's say, Atlantic Federation?

Edit: Just to inform you guys, all 1273 were present on Fornax at the time of arrest. All 1273 are not allowed to leave the country as all of them are accused of treason and murder respectively.

The Republic of Arcacia considers this to be political genocide. Though we do respect Fornax's right to prosecute, we cannot support the use of the death penalty, especially on such a grand scale.

The right to life is inviolate. Regardless of how despicable a person's actions are, no-one, not even a State, has the right to decide that person should die.

Arcacia wanted a moratorium on the death penalty, but had to settle for the removal of certain methods of execution. This does not mean that we, in any way, support the death penalty.

If Fornax executes these people, we will seek the immediate expulsion of Fornax from the Alliance of Independent Nations and will view Fornax as a rogue state. We will sever all diplomatic ties and impose the strongest of sanctions including the refusal of Arcacian authorities to recognise Fornaxese passports. Arcacia will essentially cease to recognise Fornax as a sovereign state.

The Cattalian Catholic Church supports the Arcacian governments proposed action if this genocide goes ahead. Life is sacred. The Lord told us to love our neighbours, and forgive others. The Cattalian Catholic Church requests that the Republic of Fornax considers this before they commit this atrocity.

Hiigaran Confederacy supports the dead penalty, only if there is no other way the person can be punished for his crimes. But we can not support this strongly political case. We are worried that this is a start of a Genocide and attacks on basic freedoms of Fornaxians. Hiigaran Confederacy National Clan has commented that there is a need to use force if Fornax start the execution of the people, Sajuuk-Khar will make a speech soon in New Port Council of 16.

Hiigara also call for a group to be send and to try to get information on all who wore send to prison and could be killed soon.

The Republic of Aleksania must agree with the government of Arcacia to a degree. It would be acceptable for the death sentence to be applied to any persons involved with the plotting or execution of these crimes, but executing 1,273 people is unthinkable. That would be Political Genocide on a scale almost not seen sense Stalin's Purges in the 1930s and '40s. The Republic of Aleksania will not stand for such blatant violations of the Convention on the Prevention and Punishment of the Crime of Genocide, of which Aleksania has signed and ratified. As such, the Republic of Aleksania will instate sanctions against Fornax if these charges are carried through.

Plot to assassinate Acting President Paterson
While conducting a search on all PFP compounds, the police found several evidences of a plot to assassinate the Acting President Crystal Paterson. The plot focus on her walkabout tour at Devonshire, a suburb just outside of Sypogen. It was planned that she will be assassinated on 5 December 2010, the eve of the first resident to move in after reconstruction. According to the details, a PFP member will dress up as a painter, painting the master bedroom of Kentony Street 15, house number 26. House 26 is the house the Acting President will visit during the walkabout tour. The painter will then grab hold of a screwdriver and attempt to assassinate Acting Presient Paterson.

while conducting a search on all PFP compounds, the police found several evidences of the plot of the assassination of former Acting President Pang Hon Whye.

Next week on the 11th, Fornax will be saying its verdict against 1273 criminals for several charges, 47 might be sentenced to death, while another 118 might be sentenced to caning: 37 were sentenced to 6 or more strokes of the cane, 9 sentenced to 10 or more strokes of the cane, 2 were sentenced to 12 strokes of the cane. The rest might be sentenced to imprisonment. There is a possibility that some might not be sentenced to anything, although the chance is low.

As Fornax is now an observer, is the AIN Court still neccessary for approval or Fornax have all rights to punish the criminals.

Caning is not permitted under the Constitution of the Alliance of Independent Nations as it is considered torture.

Yes, corporal punishment of this type is not permitted.

This is illegal under both constitutions - in the old and currently ratified constitution, Observers are not mentioned and therefore law in that applies to all forms of membership including observers. The new constiution which is not the official ratified constitution but still superceeding union law until complete ratification states that observers are required to comply with sections 2, 4 and 6 and are automatic signatories of those sections (the other sections are optional). Therefore this action can proceed against Fornax.

So, in other words, Fornax (an observer) is not allowed to cane prisoners. I didn't ask for this btw, but thanks for clarifying and to open for more role-playing.

But what about the court case? Is Fornax still required to go through one?
